This paper mainly focuses on the law and regulations of china's film industry. I begin with the outline of development of modern films, giving a general remark of the film industry all over the world and summing up its characters .Then, comparing with the development of Hollywood film industry, I analyze the market mechanism of Chinese film industry with the SCG model, and find out the problem of it and necessity of its regulation. At last, through comparison and evaluation of the law and regulation of china's film industry. Finding out the problems of the formulation and innovation of regulation and the insufficient self-discipline, I give the appeal of bringing in advanced legislation experience, improving our own legislation and self-discipline. This paper mainly employs the research methods of economy, comparison and logic.This paper comprises five parts.Part I generally introduces the outline of the development of modern film industry. In this part, I point out the grand challenges that the under-developed Chinese film industry is facing in the tideof globalizing. Then, I summarize the characters of film industry------itbelongs to the tertiary industry, and is characterized with such as the unification of its distribution and consumption in production cycle, providing common goods, quality of service and large economic risks.Part II generally focuses the market analysis of Chinese film industry and the necessity of regulation. With the SCG model of industrial economy,I'll analyze the Chinese film market from such four respects-----phase ofmarket development, market structure, market behavior, market performance. Then I'll analyze the market mechanism of Hollywood through its four phases of development in the past hundred years, finally point out the defects of Chinese film industry and the necessity of regulation.Part III focuses on the laws and regulations abroad. This part focuses on the legislation of film industry in America and South Korea. Hollywood is the most developed film market of the world. Its market mechanism has been fully developed. In America, the main form of regulation is self-discipline, which coordinates the relationship between government and film industry as well as between the creative freedom and social morals very well. With the help of legislation, Korean film industry develops fast in recent years. For the benefit of national film industry, Korea established laws such as Act of Film Promotion and institutions such as quota institution. Furthermore, this part also introduces concerning provisions of WTO and various attitudes to film import indifferent countries.Part IV focuses on the laws and regulations in china. This part begins with the existing laws in China about film industry, then gives detailedanalysis of the basic institutions-----examination institution. This part alsointroduces the self-discipline of Chinese film industry. Finally, it points out the problems of Chinese film industry through comparison with that of America and South Korea.Part V focuses on the regulation of Chinese film industry and proposals. I will give my proposals on the legislation, embodiment and self-discipline in the regulation of Chinese film industry.
