| The security of the rights of land is an important content of the law of property. But in the UK, which pays much attention to experience, the security of the land right is mainly not created by the theory, but gradually accumulated in the long history evolution. It is greatly different from the civil law of law of property system.This paper discusses the compulsory purchase and compensation system of the UK with concerns about Chinese issues, hoping useful for china to build the related system. This paper finds that compulsory purchase and compensation system of UK has formed a fairly complete legal system through collecting and sorting the related literature material. In the procedure of compulsory purchase, the system of UK ensures the right of the objections of the expropriated party. In the land compensation system, the law and practice of the UK give different types of compensation according to different expropriated lands. The justice of the UK provides the institutional guarantee for the compulsory purchase and compensation. The expropriated party also has right to against the acquiring authority before the right of land is transformed to it. However, the conflict between legal values is embodied in this system. Therefore, the system of the UK also has some shortcomings, for example, the establishment of offset system and the insufficient relief when land property rights transferred and so on.At present, the land acquisition and compensation system in our country also has much to be desired. At present, introducing the market value principle to our country’s compensation system is badly needed. |
