Study On Legal Issues Of Carbon Capture And Storage Market Access

In today’s world, the voice for CO2 emissions reduction has kept for several years and it’s still rising, the relevant mitigation action also unceasingly carried out. For our country, in quite a long time,new energy development and use are relatively slow, lead to one-off energy structure of our country,the coal and oil will still be the priority,the energy structure is the major source of emissions of CO2. As one of the world’s largest economy, our country has been hit by a lot of CO2 emissions for economic development, ecological safety and human health hazards, in all its aspects need to be looking for the effective of CO2 emission reduction measures. As a cutting-edge technology to reduce CO2 emissions, the application prospect of CCS(carbon capture and storage technology) is very broad, it is beneficial to help our country to achieve emission reduction targets and prevent global warming, but how to guard against the risk of CCS has become a current and a major obstacle in development, we need to have a cautious attitude towards making application in CCS technologies. The relevant legislation is relatively backward, but the development of CCS technologies need a perfect law as the support, the basic way to reconcile the two contradictions is to increase and improve the CCS market access law and thus will construct the related subject of CCS access mechanism, encourage the relevant market subjects to apply the CCS technology, make our country to be a great power which take most responsibility to cut the CO2 emissions.The main body of this article is divided into the following four parts:The first chapter introduces the concept and principle of CCS, then explains CCS technology on emission reduction potential, and also states the current status and risks of the development of CCS.The second chapter specifically discusses the relevant international conventions,to clarify the current international legal status of CCS, and also analyzes the domestic legal system related to CCS, through the introduction of legal system of the CCS in the European Union, the United States, Australia and other countries, analysis the advantages and disadvantages, and draw lessons from the foreign excellent legislation achievement, also concluded that China’s lack of a more complete legal system of CCS.The third chapter begins with the economic law regulation theory,tries to findCCS legal basis for the main subjects of market access, and put forward the legal issues of the current CCS market access in China.In the fourth chapter,I mainly discusses the core of this article, namely the ideas that puts forward for CCS market access legal system in China, describes the basic legal framework concrete in CCS project examination,especially the approval and supervision,as will as the risk prevention,control and the promotion of CCS technology.
