In today’s world, human existence and development have been affected by greenhouse effect due to global climate change. International management institution and relative organization are appealing to the masses for carbon emission reduction, and convene several global meetings to discuss solutions. Carbon Capture and Storage, as one of the most effective measures to reduce greenhouse gas emission, has been recognized by the International community. To develop Carbon Capture and Storage technique in China is extremely significant, since the special Chinese energy structure leads to massive total carbon emission. Along with the CCS(short for “Carbon Capture and Storage”) technique has been utilized in more and more relative projects, related to the growing operational projects the trends of such large-scale industrial application carbon capture and storage in our country is more and more obviously. In order to protect the smooth development of this technology in our country, research of relevant legal issues has become particularly important.The first part of this article briefly introduces the basic conception, principle, and possibility of CCS. Secondly, introduces the international conventions and agreements related to CCS, the legislation about CCS in developed countries and relevant laws and regulations of the existing legislation about CCS in China. Since then, this article conducts a discussion about CCS legal issues in the large-scale industrial development, including take carbon tax or not, the compensation of the accident, the environment and public safety risks and the financing issues, also discussed legal issues in different links, such as the legality of CO?among transport links, the long-term liability issues in carbon sequestration. Finally,proposed targeted countermeasures to the legal issues related to CCS.
