As an efficient and convenient payment instrument, the credit card is getting its popularity nowadays, and people all around the world are beginning to be accustomed to use the credit card. And after coming into our country, with the 20 years of its vigorous development, the credit card is changing our way of consuming, becoming an indispensable part of our daily life. We use credit card both in commercial area and in personal area. The credit card is expanding its coverage and we are showing more trust to it now. However,when the credit card is getting its popularity, the credit card crime is also increasing. Those crimes, especially the credit card fraud not only destroy our socialist market economy,but also do greatly harm to the security of our normal masses, and this has seriously affected and interfered with the development of our economy. We can not ignore this or pretend not to see this, and also we can not refuse to use the credit card just because the credit card may bring more crimes to us. On the contrary, we must insist on using the credit card and promote the credit card, and at the same time, we must try our best to prevent different kinds of the credit card crime, we need to develop our social economy and also keep our property safe, this is very important. In this article, by analyzing the credit card and the crime of credit card, we try to find out and solve the special problems of the credit card crime. In this way, we can provide law theory to the related crimes in practical, and this will be quite helpful. This article is divided into four parts. The first part is the analysis of the concept of the credit card and the credit card fraud. We know that if we want to study and real understand the credit card fraud, we must firstly learn the concept of them, it is the premise of all the works. In this part, we check out the rules of credit card fraud from the laws of outside countries. then,we discuss the history of our credit card law. By learning this and comparing the differences between these two, we can provide useful suggests when we revise our credit card law in the future. In the second part, we try to find out why these credit card fraud crimes happen and how will these crimes become in the future. These two parts are both very important:If we do not know the reasons of the credit card fraud, we will not get the way to stop or prevent the credit card fraud crime; and only we know what will this credit card fraud crime become,we can take measures to this in advance, so these are really important. In the third part, we talk about the three difficult problems of credit card fraud crimes which are:the first one is malicious overdraft of credit card; the second one is theft of credit card and the third one is credit card fraud crime on the internet. These three are so significant that we must try our best to solve these problems. For the first two questions, we study the rules of the law and the theory of the law, then we conclude that there are something wrong in the current rules so we suggest that if the law will be revised in the future, we could draft laws in the way mentioned in the article. For the third question, credit card fraud crime on the internet is becoming a serious problem all around the world. The internet is so powerful that all our lives will be connected to it,also the credit card fraud crime will be connected too. In the article, we try to find out the problems of the credit card fraud crime and hope this will be helpful. In the fourth part, we put forward some ideas about preventing the credit card fraud crimes. These ideas include both suggestions of the law and the suggestions of judicial practice,and we believe these ideas will do great help to solve credit card fraud crimes. preventing credit card fraud crimes will be a quiet important and really systematic work to all of us,it is so hard that we need to do more. In our society, we need the effort from our state organs, our social organizations and our ordinary people. we could not succeed if any part above help nothing. Facing the difficulties, we must dare to challenge and never give up. In reality,we need to combine the theory and the practice to do the best to stop the credit card fraud crimes. This will be very difficult for us, but only in this way,can we provide enough protection to our social property and help to develop our social economy.
