The Study On The Mechanism Of Rural Land Expropriation Procedure Of China

In recent years, the economy develops rapidly and the urbanization process runs quickly in our country, it inevitably requires a lot of land for developing and constructing, so the government frequently collect the rural land by sacrificing farmers’ land in exchange for economic interests, which is very unscientific. In addition, land expropriation system in China is not enough complete, there will be some problems more or less in the process of the implementation of land expropriation. From the point of the case in practice, such as serious illegal land event, violent acquisition lead to frequent murder cases and mass incidents, waste of land resources. These problems have big negative influence for our country, which makes researching and completing the system of land expropriation has very important theoretical and practical significance.The process of justice can promote the entity’s justice, therefore, this article choose to study the system of land expropriation from the view of the procedure, this paper mainly discusses the legal problems of land expropriation’s process in the actual operation as well as the solutions for completing the process mechanism in our country. In order to emphasis the characteristics of researching the thesis’ s ‘process mechanism’, the paper mainly discusses from the following five parts:The first part mainly introduces the basic theory of the process of land expropriation, including the concept of land expropriation and its theoretical basis, the concept of the process of land expropriation and its theoretical basis.The second part mainly investigates the process of foreign countries’ land expropriation, and analyzes the reasonable system of land expropriation which is according with the due process. The aim is to provide the reference for the improvement of the process of land expropriation in our country.The third part mainly introduces the approval process of land expropriation, and combines the fact to analyze some problems of the approval process of land expropriation in our country, then put forward the way to solve these problems.The fourth part mainly introduces the announcement and hearing process about land expropriation, and combines the practice to analyze some problems of announcement of land expropriation in our country,then put forward the way to solve these solutions.The fifth part mainly introduces the legal relief for the process of land expropriation, and combines the practice to analyze some problems which is existing in the legal relief, and then put forward the way to solve these problems.
