| Since "the 11th Five-year Planning " implemented, regional economic development act a very important role in China. However, compared with the hot activities, regional economic development has been being lack of system construction including ensurance originated from the rule of law. Because regional economic development impacts on the boundaries of administrative division, the traditional cognitions of state law and state power is tansforming obstacles of regional economic development.In order to break the constraints of "law in book" and release the pressure from state power, we must offload the burden about traditional cognitions of source & effect.Compared to the traditional juristic research, this essay especially applies legal sociology and field investigation. It realizes the harmony in legal sociology and empirical analysis.To start with, utilizing the comparative method to analyze the regional economic plan with "living law", we find the attribute of "living law" in regional economic law. Next part, we know that regional economic law has the feature of "soft law" through illustrating the implementation experiences with "soft law" at home & abroad. Finally, based on the above research, this essay tries to frame the rule of law on regional economic development.The goal of research is the system establishment in regional economic law with new perspective. We could conclude that regional economic law is combination of "law in action" & "law in book", the implementation of regional economic law need both "soft law" & "hard law" meanwhile regional economic coordination organization ought to balance interest as well as consolidate operation. |
