Regional planning is the spatial layout of a certain geographic range,development intensity and development goals provide principled deployment guidelines.In recent years,the State Council to actively promote regional development,by the end of 2015,has issued 53 national strategic regional planning.In regional planning more and more attention today,we also want to see clearly the establishment and implementation of regional planning,still faces many difficulties,whether regional planning should be the object belongs to legal regulation,part of the legal system are not clear.The fundamental reason is the laws and regulations of our country the serious shortage of supporting institution supply is serious lack of regional planning to the rule of law.This paper analyzes the meaning and characteristics of regional planning,and on the basis of the regional planning has the attributes of economic law are described.The creation of regional planning and the implementation of economic law basic principle and objective,is to refine the object of economic law,the pursuit of value concept,the basic content and the economic law is very fit.Therefore from the angle of economic law,regional planning provides the legal regulation is the economic law is not the responsibility of speech.Regional planning also has hard law and soft law attribute,part of the regional planning has the characteristics of hard law,but also has general applicability,and regional planning and is the embodiment of public policy,public policy is the soft law.Our country is in a complicated social transformation period,regional planning law the current is a long-term project is a complex system,because there is a complete regional planning system is not perfect,lack of security planning body diversity,the Constitution and the basic law,need strong security features,in addition,because of hard law and soft law have their own flaws and shortcomings,guarantee by soft law or hard law is not enough,I The realization of the rule of law in China's regional planning needs hard law,soft law,a mixed dual security model.By listing,analysis of Regional Planning Law in western developed countries and developing countries in the aspects of soft law protection,we see all countries attach great importance to the construction of legal system of regional planning,but different aspects of soft law protection and the dependence of the different emphasis.Specifically,the regional planning law to realize the democracy into the legal system.Extensive consultation and public participation,to solve specific problems and formulate specific areas,the most important needs of soft,hard double protection method.On this basis,put forward in the implementation of regional planning legalization construction security model preliminary ideas hard and soft law.To sum up,the regional planning of the rule of law must be used to achieve soft,hard law a mixed double protection mode.Based on the combination of soft and hard law protection,the main location,clear regional planning responsibility and authority;clear legal responsibility in the planning,improve the accountability mechanism;full supervision system,mechanism effect,and improve the interests of the infringement of legal remedies,and ultimately to achieve regional planning of the rule of law.Through the construction of regional planning hybrid governance mode,do double protection soft law,realize the regional planning of the rule of law is the core essence of this paper.
