The Dairy Safety Regulation Legislation Analysis

Nowadays, dairy food has become an indispensable food in our daily life, infant milk is affecting the next generation of healthy growth. Therefore, the importance of the dairy safety regulation is self-evident. However, many dairy safety incidents occurred in China in recent years show that in dairy production, processing, circulation and consumption of all aspects of its regulation have emerged severe test.Regulated combination of countries, this relates to public health of the dairy industry to be the regulatory body and the specific regulatory approaches to be determined by the form of legislation and effective implementation of the regulatory activities. This thesis will focus on these two core issues, namely, "who supervision" and "how regulators".This thesis will firstly introduce the basic concepts and theories related to dairy safety regulatory legislation; Then, on the legislative status quo of China’s dairy safety regulation as well as the analysis of existing problems, problem is mainly manifested in three aspects: imperfect relevant laws and regulations, the existing dairy safety regulators set unreasonable, legal specific content regulation is defective; Followed by introduction of representative foreign countries (region) of the dairy safety regulatory experiences, they are the USA, European Union, New Zealand, and sums up the foreign dairy safety regulatory experience on our country’s enlightenment.To solve these problems, the last chapter of this paper put forward the corresponding improvement suggestions. The improvement of relevant legal system, the proposed should focus on improving the existing laws and regulations systematic, poor coordination and the status of lag. Perfect setting for our dairy safety regulators proposed to further consolidate and clarify the responsibilities of the regulatory authorities; While improving the roles and responsibilities of the coordinating body. How to improve the specific content of existing laws and regulations, this paper presents five proposals:1. Improving the existing laws and regulations specific degree of dairy safety; 2. Adding the cost of illegal dairy enterprises; 3. Improving the legal and regulatory standards, certification and inspection system of dairy safety; 4. Improving dairy safety’s administrative accountability and information disclosure system; 5. Establishing strict traceability mechanism in dairy safety.On the research methods, this paper mainly adopts the literature survey analysis, comparative analysis, and the combination of theory and empirical research methods. Through this thesis, hoping to do some contributions for improving China’s dairy safety regulatory legislation.
