The Study On Act Of Omission Of The Policeman During The Public Security And Executive Law-enforcement

As the public order administrative organs of our country, public security organs shall perform the relevant administrative duties in accordance with the law, to maintain public order, protect the interests of the state, public security and citizen’s life and property security. In the policing activities, policeman in public security organs should use state power and means in accordance with the law. So the responsibility of enforement is not only major, but also attracted a lot of attention. In recent years, the phenomenon of "omission of the policeman during the public security and executive law-enforcement" is more and more outstanding, which leading bad social impact. After The party’s Fourth Plenary Session of eighteen, "further promote according to law, accelerate the construction of rule of law in government" becomes one of the six major tasks of "Comprehensively promote the rule of law". In such a background, the administration according to law is more and more attention. In this article, we will first analyse the phenomenon of "omission of the policeman during the public security and executive law-enforcement" and give the definition; secondly analyse performance and hazards, and further analyse the causes of the phenomenon; Finally, aiming at the problem, offer three proposals as perfect the laws and regulations, standardize law enforcement activitiesand strengthen the supervision of law enforcemen. Hope that the enforcement actions of policeman is running in more standardized track.
