Food Safety Industry Association Supervision Legal System Research In China

Food safety problems have become a topic of concern around the world. In recent years, China's food safety accidents happened frequently fully exposed the food safety of the gravity of the situation, the presence of large amounts of food field of market failure and government regulatory failure problems. By formulating the Food Safety Law of the People's Republic of China, take the food safety supervision further into the legal orbit. But, we should be realized that the single government supervision of food safety exists many problems, this seriously affecting China's food safety regulatory efficiency. Therefore, how to improve regulatory efficiency of food safety becomes very important issue.This paper based on the perspective of China food industry association to analysis the effective interaction between the government supervision and the industry association supervision. Using empirical analysis method to analyze the advantages of food industry association in overcoming the market failure and government failure, and gets to conclusion that the supervision of food industry association is an effective method to remedy the dual-failure mentioned above. Using standard analysis to discuss effective System model to food safety industry association supervision and government supervision; Using Theory of Public Choice in Economics to analyze the theoretical basis of the food safety association supervision; Using Sociological theory of Dynamic social contract theory to demonstrate rationality of food safety industry association supervision;Using Case Analysis Method, based on the comprehensive analysis of"SanLu"events, elaborated unique advantages of the food industry association. At last, from the self building of food industry association, the external environment, the Specific content of food safety industry association supervision, and how to properly handle the relationship between food safety industry association supervision and the food safety government supervision, and draw a conclusion through the above analysis: We should try to perfect the government supervision of food safety, at the same time, we should give great impetus to system construction of food safety industry association supervision, achieve benign interaction of supervision between food industry association and the government, thus form a cohesive force of supervision, this line of thinking Should become diligently direction of perfect of food safety supervision.
