The Study On The Legal System Of Policy-Oriented Agricultural Insurance

Policy agricultural insurance refers to the compensational and political financial activities that government or other insurance management organizations pay with financial subsidies, tax incentives and other means to assume the responsibility for the economic loses caused by specific incidents, natural disasters and other agricultural risks in the process of planting and breeding. Policy-oriented agricultural insurance legal system, including the policy-oriented agricultural insurance subject system, policy-oriented agricultural insurance supervision system and policy-oriented agricultural insurance government support system, is a general term for the various legal systems and norms which are made by the government for politically supporting and supervising the conditions and procedures of working on policy-oriented agricultural insurance. The current has preliminarily established the legal system of policy-oriented agricultural insurance in China, but the subject system, supervision system and government support system of policy-oriented agricultural insurance are not complete and perfect. The practice in other countries shows that we shall set a reasonable policy-based agriculture insurance system by legislation to develop Chinese agriculture because the subject system acts as a foundation, a complete supervision system is the key to the development and the government support system plays as a powerful guarantee in a policy-based agricultural insurance system. Combined with the practical situation of our country and other countries’ experience, the paper states that China should perfect the law subject system of policy-oriented agricultural insurance from the following three aspects: one is to rationally and legally choose business model, the second is to improve the marketing access system and the third is to protect the rights and interests of agricultural producers; to complete the supervision system needs to indentify the insurance regulatory body and confirm the supervision object; perfecting government support system requires to fulfill regulations of fiscal subsidy and improving the legal system of policy-oriented agricultural reinsurance.
