Along with the progressing of the history, people’s concepts of criminal law are changing. The humanism has been gradually developing and the educative punishment theory has been gradually rising. Correction, instead of punishment, becomes the key word in the execution field. Under this background, community correction came into being and gradually developed. Up to 60s of the 20th century, Community Correction system gradually flourished in the west. However, for a long time, there is no Community Correction in China. In recent years, with the advance of democracy and the rule of law, China has also begun to attempt the socialization of executing and the Community Correction comes into pilot and exploratory stage.In this paper, starting from a comparative study from portrait to landscape orientation, we take in a sociology theory——embedded theory, to look at China’s Community Correction work in a unique perspective. We point out the existence of the embedded dilemma of our community correction and make specific recommendations. This paper is divided into four chapters. The first chapter is the introduction, which points out the central issue of this article, the research method and the significance. The second part is an overview of the community correction issue. We explain two most important concepts——Community Correction and Embedded Theory in this part and make an exploring on the history of the Community Correction and the development of the Community Correction in foreign countries. In the third part, we take the embedded theory into the study of the Community Correction, analyzing the present situation and main problems in China’s Community Correction and we highlight the predicaments we are facing. In the fourth part we raise some recommendations and also make a conclusion at last.
