With the acceleration of rural economic development and urbanization of rural, the land showing a trend of rapid development, as a grass-roots mass self-organization, the Constitution the village defined its role in their healing process clearly is more important. In practice, the legal nature and the Constitutional status has been criticized, and it’s position in the land transfer process is so ambiguous, that produced a series of complex social problems in the process of social practice. In this paper, we will research the function and role of the Constitution the village in the land transfer process based on it’s legal status to get a more clear understanding of the role of the village in land transfer.In this paper, we mainly taken the normative analysis and empirical research method to research the role of the committee in land transfer process.As we discuss the theory,we also take a lot of relevant practice status as evidence to provide strong evidence for the scientific research. In this way, we could avoid the theoretical study depart away from the practical need.In the first chapter, we make a comprehensive narrative of the constitutional status. Starting from the basic legal status,and then discusses the village’s special constitutional status in the land transfer.It is mainly for the village and township government in the organization, guidance, service differentiation, and regulatory aspects of the work of rural land, as well as the differences with farmers in the land transfer process in subjectivity. In general, it is a two-way acting role as "intermediary".In the second chapter, we described the basic responsibilities and the main functions of the village in the land transfer process.it is mainly about serving the villagers, assisting management and provide services and other forms of behavior supervision to operations in it’s way...The third chapter points out the missing of village in the land transfer, analyzed and discussed it from the service villagers organize circulation, three aspects of the exercise of power to engage specific village land transfer issues arising from the project. And in the the chapter IV, we mainly research the various reasons of village’s role missing from the aspects of legal norms, the village itself, human factors, and other specific analysis of the monitoring mechanisms.In the fifth chapter, we try to solve the existing problems about the problem that the village appeared in the land transferring. Focused on the existing problems and combined with the West advanced experience what can we learn, we try to propose remodeling ideas from the normative legal, functional aspects of the village committee, the compensation mechanism of supervision and inspection aspects and afterwards In order to solve the existing village’s in the absence or offside situation in land transfer.
