Study On Citizen’s Environmental Right Of Rural-Urban Continuum

With the accelerated development of urbanization in China, the rural-urban continuum has gradually formed in our country. However, the rural-urban continuum is the blind spot for administration in the process of urbanization which has created obstacles for improving the urban economy,image and living environment.The rural-urban continuum as the main heavy industry base of the city economic development that the ecological environment is extremely serious.While the residents living in this area are mostly urban households and farmers and workers of the former residence.Because most people lack the ability to change the situation that being relocated,so they can only accept the current situation.Thus,the environmental right of the citizen who are living in the rural-urban continuum that being severely Infringed upon.Due to the rural-urban continuum that across the country came into being with the regional economic development and in the course of urbanization,so the phase of life problem of the citizen in these areas all have similar characteristics.thus,the problems possess universality.In this paper, I will investigate by Changchun City, combination of urban and rural residents living circumstance, the environmental problems faced for Changchun urban fringe is analyzed, and then the integration of urban and rural residents general problem of Department of environmental right to study and explore.In this paper, I will discuss the residents’ environmental right of the rural-urban continuum.First, I will elaborate the necessity and the research background and significance of the topic of this paper and the comprehensive analysis of the development situation and development trend of residents’ environmental right theory at home and abroad, a clear focus and direction of this paper;Than,I will defines the concept of the rural-urban continuum and the residents’environmental rights, elucidate the form of the rural-urban continuum, the specific environmental problem it must face and the particularity for the residents’ environmental right of the rural-urban continuum. It is paving the way for expounding the problem that the residents’environmental rights of the rural-urban continuum faced;Based on these, I combined with the realistic problem of the residents of urban and rural environment right is expounded; and the influence of China’s urban and rural areas to realize the combination of factors of the residents the right environment analysis. This part will through the analysis of the survey data and living status of the department of urban and rural residents with analysis of difficulties and problems, summed up the integration of urban and rural residents’ environmental right face;Last, puts forward the countermeasures to perfect the protection of the residents with the right environment for China’s urban and rural areas. Based on the development status of the comparative analysis on domestic and foreign residents of environmental right, to explore more effective legal operation mode, in order to explore the way of combination of China’s urban and rural residents in the realization of the right of environment.
