Circular Economy Promotion Law Implentation Of Goverment-led Research

Since the implementation of the "Circular Economy Promotion Law" four years ago, government, enterprises, the public and other social organizations have promoted the development of recycling economy jointly. However, the issue of what the role government should play in the implement of "Circular Economy Promotion Law" is always paid insufficient attention to or even ignored. In view of this, with the aim to help our circular economy developed legally, based on circular economy and related legal theory, combined with the current development of circular economy in our country and the experience of developed countries and considered of the latest theoretical results abroad, the issue of the government dominance in the implement of "Circular Economy Promotion Law" is discussed in this paper.The effect of "Circular Economy Promotion Law" is analysed in part one. First, after the analysis of the government, market, enterprises and the public, we can draw the conclusion that the development of circular economic needs the participation of the above four parts. Second, we can obtain the result that government is playing the most important role in the implementation of "Circular Economy Promotion Law" through the comparison of the effect of these four subjects.The second part describes the need for a government-led "Circular Economy Promotion Law". With the analysis of the intrinsic properties of the circular economy, we can find that circular economy has the properties of externalities, public and incomplete information and concluded that government-led is the certain choice.The third part introduces government functions and enlightenments of circular economy legislation abroad. Taking Japanese and Germany for example, the advanced institutions and government positive actions are discussed. On this basis, the enlightenments of foreign legal system of circular economy are concluded.The fourth part is the key point of this paper, views and suggestions about how the government reflects its leading position and transforms its function are proposed. From the perspective of government functions, it is derived that the government-led mainly reflects in four fields of making plans, providing service, giving guidance and proper regulation. Meanwhile, the structure of institutions is proposed, including financial system, information disclosure system, green consumption system and property rights system. Lastly, it expounds that when "Circular Economy Promotion Law" is implemented, attention should not only paid to the function of government, but also to the prevention of government’s functional failure.
