In recent years, Extreme high temperature occurred frequently,ice and snow melt, sea level rise, such environmental problems is increasingly threatening the survival and development of human beings. Climate problem especially the Greenhouse gas emission has became the focus topic of the world. Among the Greenhouse gas emission problems, Carbon dioxide emissions was highly-profiled.Worrying about the carbon leakage which may cause the reduction of industry competitiveness, Some developed countries carried out Carbon tariff measures in grounds of that the developing countries are not carrying the responsibility for carbon emissions which will make their products less competitive. Once being put forward, The Carbon Tariff caused a heated debate in the global scope. Most scholars put forward their oppositions, taking for that Carbon Tariff violated the WTO rules on the legal level, it is illegal. In addition,it has not play a significant role in controlling carbon emissions,on the contrary, it’s a green barrier put forward by the developed countries to protect their own trade. People who support Carbon Tariff consider that Carbon Tariff helps to encourage countries to carry out activities to reduce carbon emissions actively. Helps to curb the greenhouse gas emissions, and then, to slowing down the environmental degradation effectively.This paper analyzed the relationships between carbon tariffs and the article 1 and article 3, the introduction and paragraphs(b) and(g) of article 20. It is concluded that the Carbon Tariff may not violate the WTO principles. On the contrary, it can be lawful Under some certain conditions. There some possibilities that Carbon Tariff can be legitimate by quoting article 20 of GATT, which contains general exception clauses about environment. In the meantime, the status quo in China’s export trade and energy consumption were analyzed, the conclusions were that the Carbon Tariff may Deteriorate export environment, Cause exports decline in different levels, Promote the upgrading of the industrial structure as well as the development of low-carbon economy, and then find out what countermeasures China can take to response to these effects,Looking forward that our country can deal with Carbon Tariff measures calmly.
