Study On The Legal Protection Of Network Personal Information

As Internet technology changes rapidly, the society has made great strides in entering the Internet age. All kinds of the information are to be interacted frequently due to the needs of internet commerce at a distance, network communication, consumer credit and database marketing etc. The national government and the public have paid more and more attention to the safety and the protection of personal information data on the Internet.To ensure the safety of personal information and to safeguard national security and social benefits is the foundation of guaranteeing the lawful rights of citizens and artificial persons. Such as the indulgence of citizen’s personal information maliciously used and the illegal trade will have serious consequences for national stability and social harmony.In December 2012, China promulgated the "on the strengthening of the network information protection decision". The "decision" has further highlighted an escalation in protection on the Internet personal information. But overall, the relevant legal system of the internet information safety protection in China is not perfect and has not been fully formed into a rigorous one.The aim of the research is trying to put forward some comments and suggestions of improving the legal protection of internet personal information, by the status quo analysis of the legal status of internet personal information protection, constitution and tort liability and China’s network of personal information protection, combining with the "on the strengthening of the network information protection decision".
