Study On Improving Legal Protection Of Fundamental Rights Of Girls

The number of young person under the age of18years old is400million, female accounts for about half, the protection of girls’ rights and interests is not only the fundamental requirement for achieve gender equality in constitution, but also the consistent voice that the international society fights against sex discrimination. In1979, the UN Decade for Women medium-term world council issued "Elimination of all forms of discrimination against women", the treaty not only provides female with various rights, but also asks contracting party countries to fully guarantee the survival and development of girls’rights according to their national conditions. The United Nations Children Funds uses "Life cycle summary" to examine girls’ life needs and rights in their different stages, it finds that gender discrimination are full of girls’ life culture and social atmosphere, but most national children projects for children services are neutral, for example, the projects for help girls in poor families also use neutral education materials, and a large part of disadvantageous conditions that female faces in society comes from discrimination against girls, girl issues didn’t get attention from various meetings and reports. From the view of law research, the legal protection of girls’basic rights are involving different levels of legal issues as the issue of law-protection for vulnerable groups. From the conclusion and compliance of international treaties to the guarantee and implementation of basic rights of Constitution, and specifically to the formulation and implementation of various kinds of laws and administrative regulations, we need to study the corresponding countermeasures from different aspects of legislation, law enforcement, and law-abiding.And then this paper introduces the progress of the protection of girls’ rights and the legal status of the protection of girls’ fundamental rights in China in recent years, and then analyzes the deficiency of the protection of girls’ rights in China from legislation, law enforcement, and jurisdiction, and analyzes the reasons causing such deficiency, the reason can’t be explained clearly only from one aspect and level, it includes the habitual qualitative for gender differences in traditional thoughts, the full containment of feudal patriarchal culture on women makes girls’ development issues fail to get attention and improvement for long time, it also includes the legislation’s poor understanding of girls’ specific status, girls are under a vulnerable position in gender and age, and most of laws and regulations only make legal protection from children’s rights and women’s rights these two aspects, they didn’t place emphasis on such a large population in the legislation. Finally, through the analysis of the roots of girls’ development problem, combined with China’s specific national conditions, this paper proposes some suggestions on how to solve difficulty in girls’ development:1) Need to change traditional views, strengthen the subject consciousness for girls’education, generalize the concept that making healthy development for girls can benefit to whole society, to construct the discourse right of gender equality.2) Improve the legal protection of girls’ basic rights from legislation, law enforcement and jurisdiction total three aspects, to work out systematical and perfect legal system for the protection of girls’ rights.3) Strengthen the protective measures of school, family, and society for girls.
