The Research On The Problem Of Applying The International Treaties Domestically

The thesis mainly expounded the theory and practice of applying the international treaties domestically, especially applying in China, which was based on the summarization of the international treaties'conception, characters and efficacy. In the light of our country's perplexity in theory and abuse in practice of this problem, the author put forth some his own thoughts and suggestions to the problems about the position of the international treaties in our country's law system, the applied way of the international treaties, the settlement of the conflict between treaties and domestic law, the efficacy of direct applying the treaties,etc., and hope to give his little help to our country's legislation and judicature of applying the international treaties.
