Legal Research About Grassroots Government’s Functional Transformation In The Urbanization Process

"Urbanization" is the historical stage that the other countries have been past orabout to enter the process of industrialization，the experience is a reflection of socialchanges in the process of modernization. From2013，a new round of urbanization hasbeen under planned，this round of the urbanization is a process which about theindustrial structure，employment，living environment，social security and othercomprehensive urbanization. In2014March "national model town planning" has beenannounced that it clears China’s new urbanization development direction and the road.The legal problems of the transformation of government functions refers to the periodof state administrative organs of the urbanization process，according to the needs ofnational and social development. It is in accordance with the law on theresponsibilities and functions，scope，content，mode of transfer and change ofgovernment functions. It is a way to explore how to configure in accordance with thelaw，how to exercise，how to pass laws to rectify the problem.This thesis consists of introduction and main body includes five parts.The‘abstract’section is the introduction to the background and significance ofthe legal problems of the transformation of local government functions in the processof Urbanization，research contents of the thesis，research ideas and research methodsas well as related research in the country and abroad， all of those support thetheoretical framework of the entire thesis，clear the main research ideas and pave theway for the main part.This thesis contains four parts: The first part is about analyzing the related theoryof urbanization and transformation of local government functions which illustrates theconnotation of urbanization and transformation of government functions， thenanalyzes the characteristics and principles of the transformation of local governmentsin the process of urbanization. Furthermore it introduces the strategic plans of thelatest urbanization. The second part is about the responsibilities of the localgovernments in the process of urbanization which includes building legal system by law，implementing the plans by law，promoting the optimization of urban layout，implementing land management reform，providing facilities and public service by lawand so on. The third part analyzes the lack of law in the transformation of localgovernment functions. To start with plan，layout and construction as a whole，detailsin legal consciousness，administration basis，law enforcement and supervision，discuss varies of illegal phenomena made by the local governments for the lack of lawrules; The fourth part continued the discussion above， specifically addressesadministation by law is the basic path of urbanization in the transformation of localgovernment functions， other paths are cooperation and mutual benefits.
