A Study On The Public Involvement Of Law Mechanism In Budget Formation

In recent years, The gap between rich and poor widens increasingly, thus cause the social contradictions increasingly. These problems indicate that today’s public budget can only meet the requirements of the government’s GDP growth but cannot meet our demands on the public to increase revenue, improve the living environment and improve the quality of life.The objective of modern budget should be providing public goods and services, it is not intended to meet the government’s own interests, but to realize the whole social economic growth and meet the needs of the majority of the public. In order to achieve the main goal, and analyze current problems of China’s public budgeting process, as far as I am concerned, the introduction of public participation mechanisms in the process of budgeting is very necessary.Citizen participation is the right of citizens in a country, as masters of the country, in accordance with the provisions of the law, through various ways and forms, to participate in the management of the country and social affairs, to promote decision-making more scientific and democratic. Specific to the field of public budgets, public participate in the budgeting process not merely can achieve the right to public participation, but allow better understanding of the use of financial resources that related to their own interests, even can express their demands in the process and use their rights better.On this basis, through the analysis of the present situation of the budget practice, we found in our country, promote civic participation in budgeting legal mechanism exists the following obstacles. First, the lack of legal basis; Second, the ability of citizens to participate in government and were insufficient; Third, the lack of participation channels. After a comparative study of foreign public participation in budgeting practice and learning from the advanced experience, four aspects are expounded to our country to establish public participation mechanism of budget law. The first is the construction of the Constitution as the center of the budget law system. Second is to enhance the ability of subjects participation. Finally is to innovate participation channels, establish budget hearing system, and establish the budgeting mechanisms that social organizations involved in.
