Analysis And Recommend Of The Law Issue Of Regulations Of The Right To Address Questions In China

The realization of The right of supervision in the national people’s congress exert a great importance on the operation of the nation’s power and protection of the human’s rights,as one of the important forms of the right of supervision,The right to address question has been ignored no matter in practice or in theory,which has influence and even been detrimental to the realization of the right to address question.As the basis of the implement of the right to address questions.The improvement of the right to address questions has a great importance on the function of it.This essay focus attention on the regulations of the rights to address questions.Firstly it elaborates the conception,nature,characteristic,function,source and development of the right to address questions.and then it introduce the content of current regulation of the right to address questions, meanwhile it analyzes the problem from five perspectives in the area of the substantive area,which are the collectively performance of the right of the member to the national people’s congress, the improper distribution of the quantity of people who propose the right,the flaw to the content of the right.whether the judicial authorities or the single people are the object.In terms of the procedural area,it analyze the question from four perspectives,which are the time limit of proposing this right.the formal limit of proposing the case which is concerned with the right to address question,the indistinct of regulation of the respond to the question.the lack of the result procedure.At last,it combine with some relevant regulations of the western congress and make suggestion in the substantive and procedural areas.the former propositions include:broaden the qualification of the people who can address questions,add relevant regulations to the content of the rights, affirm the judicial authority and the relevant who is in charge as the object to be addressed question.the latter propositions include:initiate procedure,respond procedure,result procedure.
