The rapid development of network in he21st century brings the great expansion of depthand breadth of people’s thoughts. With the rise of the number of Chinese netizens, a newpublic opinion position---network public opinion forms. Then network media enter into thesocial life, and highlights the amazing power of corruption, for example, citizens expose theshortcomings of the government, such as corruption and malfeasance by the use of network.Network whistleblowing reflects on the political supervision of people, which plays animportant role in building a clean and honest CPC Party and and resolving the corrupt.The enormous impact of network whistleblowing and the widespread concern it attractshas positive implications for democratic oversight of China. However, if we just focus onsome specific network scenarios, or the appearances and power of the networkwhistleblowing, it may miss the bigger picture, or got into predicament of seeking a quicksuccess in academic research. In academic circles, the study of network media are mostlymonitoring, guidance and regulation of public opinion, they seem to take a resistance to thenew anti-corruption platform and new ways that citizens participate in politics, it makes sigh.Therefore, in our democratic politics process, we must safeguard the healthy development ofthe network whistleblowing, play its functions of political oversight and anti-corruption onthe basis of free expression, explore the legitimacy of network whistleblowing, in order tohelp people disclose the shortcomings by the use of network. Based on the above purpose, thepaper is organized as follows:Part I: network whistleblowing and freedom of expression. On the basis of analyzing thelegal characteristics of the freedom of expression, the article, from the start of elaborating therelationship between network whistleblowing and freedom of expression in Constitution,demonstrates the legitimacy of network whistleblowing, it is a manifestation of freedom ofexpression, including the basic concepts of freedom of expression in Constitution, themeaning, characteristics, legal nature of network whistleblowing. It reaches that network whistleblowing first is a free expression of will, and an extension of freedom of speech by theinterpretation of the second part. What’s more, it is a new way of citizens’ political oversightin the Internet era.Part II: network whistleblowing and democratic supervision. The paper discussesnetwork whistleblowing as a new way to supervise the government plays an important role inbuilding a clean and honest CPC Party and and resolving the corrupt from the two aspects ofthe constitutional right of citizens and supervision ways of the government. Networkwhistleblowing as a new way of democratic supervision has its legitimacy.Part III: the extraterritorial legal protection of whistleblowing right. It introduces theFourth Power that citizens oversight government in western countries, like the United States,Germany, and illustrates the legitimacy of citizens disclose the shortcomings via the networkfrom the experience worldwide. This part incluses the legal protection of the Fourth Power inUSA, and whistleblowing right protection in Germany. And it demonstrates the legitimacy ofour network whistleblowing from the experience around the world.Part IV: the problems and cause analysis of network whistleblowing. Problems includenetwork whistleblowing is lack of legal norms, and it exists group polarization phenomenon.In network whistleblowing process, Internet culture is missing. This part analyzes four causes,including lack of the attention of the top designers, system deficiencies, the weak sense ofself-restraint of users and the particularity of network operating environment itself.Section V: it presents some improved measures of network monitoring on the basis of thefourth part. Firstly, the top designers should fully understand the importance and complexityof network monitoring. Secondly, provide legal and institutional guarantee for networkwhistleblowing. Thirdly, improve the quality of network participants. Fourthly, clear theresponsibilities of online media agency. Fifthly, set a clear legal responsibility. It puts forwardsome concrete measures to improve and perfect our network monitoring by the five aspects.
