The officials as a positive example of the ancient Chinese official group and the model ofthe judicial practice, respected by all previous dynasties, the study of the judicial officialswill help us learn more about of the ancient judicial philosophy, such as the resolve disputesand ruling of the case method, etc. The research object of paper is he Han Dynasty period ofjudicial officials.Base on the analysis of the basic historical data and the reference for somescholars in the study of the officials,This paper using the traditional historical researchmethod, first analyzes the characteristics of the Han Dynasty officials, and then throughsummary and analysis the records in the book named Records of the Grand Historian andHistory of the Han Dynasty, concludes that the officials of the Han Dynasty “according tolaw”,“judicial justice” and “education and punishment” three judicial philosophy, and as thefocus of the article, it mainly discussed in this paper. At the same time this paper furtherpoints out that the judicial officials are different from the “cruel officers”, it was also becausein the process of judicial officials grasps the judicial idea. Then, the paper analyzes the effectand skill of judicial officials in the Han Dynasty, the officials in the judicial practice wisdom,flexible to use its solving achieved good legal effect and social effect. Finally, on the basis ofthe argument, the paper points out that the judicial officials in the Han Dynasty reflected theway of act as “a officials” and “a teacher” and the judicial of Han Dynasty also solve thequestion of legal certainty and appropriateness.
