The Analysis Of Filial Piety Into Law In Han Dynasty

The Han Dynasty is an important growth period of Chinese legal tradition, and has greatinfluence on the thousands of years of legal construction of our country, but also thegermination period of introducing Confucianism into laws. So, study on the Han Dynasty’slegal system is of great significance for the research of Chinese legal history. And the study oflegal system of Han Dynasty, must be in the macro at the same time, from the details, makeclear the characteristics of legal system of the Han Dynasty, the important role of filial pietyplays in the legal system in Han dynasty. Therefore, this paper will be based on the clearrelationship between filial piety and legal system of the Han Dynasty, the performance offilial piety in the Han Dynasty’s law, analyses the reason of the filial piety in Han dynasty andlaw fusion, and explore the filial piety in Han Dynasty into laws related to think and to learnfrom.In general, this paper is composed of introduction and text. In the introduction, theauthor briefly introduced the topic origin and significance in theory and practice, researchstatus, research ideas, research methods and innovation of this paper.The first part of the text as the origin of filial piety into law, tries to give a clear track ofeffects of Confucian Thought on legal system in pre Qin period, Qin Dynasty at that time.This paper focuses on the development of introducing Confucianism into laws in HanDynasty..The second part is overview of filial piety into law of the Han Dynasty. This partintroduces the background of Han Dynasty by fusion of filial piety and the legal processrespectively. At the end of Qin Dynasty national peasant uprising to overthrow the powerfulQin, the urgent problem which Han Dynasty’s rulers face is how to ease the sharpcontradictions, recuperate and build up strength as soon as possible to restore national stability,promoting economic recovery. Fusion of filial piety and law in Han Dynasty was divided intothree stages described, respectively as the emperor of Han Dynasty before, to the HanEmperor Zhang period, after the Han Emperor Zhang.The third part of the text is the embodiment of filial piety in Han Dynasty into the law.The part introduces the regulations about filial piety in Han Dynasty law from three partsmainly, including laws to promote filial piety and legal punishment of unfilial, bending the law for "filial piety. All aspects and angles to show filial piety in Han Dynasty make clear of aregulation of the law, so as to better understand the main content of the full text and views.The fourth part of the text is the thinking and reference of filial piety into the law of theHan Dynasty. By analyzing the reasons of filial piety and legal integration’s integration ofHan Dynasty, and discussing its historical position, consider its value and reference for ourmodern social. How can we face the filial piety which inherited thousands of years? Whetherthe ruler’s approach is flawed or not? We should discard their dross and select their essence,building blocks for the construction of socialist legal system.
