Qualitative Research On Extortion By Fabricating False News Of Explosion

In recent years, there are more and more cases of the behavior of fabricating false newsabout terrorist activities to extort. Generally, the offender should be convicted of fabricatingor advisedly spreading false news about terrorist activities, if his actions seriously disruptedsocial order. However, with the ever-changing criminal means and increasingly complex case,there are more and more cases of using false terrorist mews to extort. Because of the lack ofdetailed provisions and the theory, there are many different opinions about how to convictsuch crime. According to the contradistinction of disputed charges, the author cites the case ofZhangmou fabricating terrorist news to explore the disputes of how to convict the behavior offabricating false news about terrorist activities to extort.This paper is divided into four parts:The first part introduces the basic situation of the case this section describes the cause ofaction, case description, the disputes and disagreements, and cases focus respectively.The second part introduces the legal analysis. This section focuses on case-related legalanalysis. Firstly, the author analysis the difference between the disputed charges. Secondly,the author analysis two aspects: whether defendant Zhang’s behavior is endangering publicsafety, and whether they are "other dangerous behavior". According to the result, the authorconcluded that whether fabricating terrorist news to extort constitute the crime of endangeringpublic safety. Thirdly, based on the analysis of law theory, the author concluded how toconvict the behavior of fabricating false news about terrorist to extort. Finally, the authordiscusses the problem of the form of the crime.The third part is the study conclusions of this case. The author believes that the offendershould be convicted of a crime of fabricating false news about terrorist.In the end, the author put forward to legislative and judicial recommendations.
