On The Reform Of The Household Registration Management System Of Law In China

Freedom of movement is the right that law and Constitution of Modern civilizedcountry given, which means that every citizen have the right to leave their originalresidence to other place to travel, settle down and work. Residence and freedom ofmovement is an important part of Civil liberty and also vital one of the fundamental humanrights. The right of movement is the fundamental constitutional rights. Since China builtin1949，supported that financial crisis, the strategy that give priority to the development ofindustrial and cities is conducted. In1958, the passed law《People’s Republic of ChinaHousehold Registration Regulations》resulted in unique dual urban in China, whichdeprived the right of movement and also violated the principle of equality law essentially.Migrant workers problem is a typical performance. According to the statistic from relevantapartment, up to Jun.2014, the number that migrant workers in China has reached174million, which increase3.07million compared to the the previous year. This paper usesmovement of freedom as the perspective. By deep thinking and research of the HouseholdRegistration Regulations in China, the paper introduces the Household RegistrationRegulations in Taiwan and foreign countries and analyze the highlights and Inadequate ofthe Administrative regulation《Opinions on Further reform of the household registrationsystem》promulgated by the State Council. In this paper, the author has come up withlegislative proposals about reforming the existing household registration system to realizethe freedom of movement.
