“Kings are those who govern; civilians are those who need governance; officials arethose who promote governance to benefit the civilians. Therefore, good officials willensure justice and sound governance, and bad officials will invite slack governance andfailure.” Rulers in ancient times had fully realized the perniciousness and severity of dutycrime. Due to that, the wise rulers in past dynasties all took strict precautions against thecrimes by taking advantage of duty, especially bribery crime, and strove to maintain thestabilization of the society by such a way so as to achieve the long-term peace and order oftheir dynasties.Through summing up the experience of previous dynasties, Tang dynasty set up asystem of controlling duty crime featured by rigorous legislation, comprehensive contentand complete organization, hence laying a solid foundation for its early flourishing period.In the governance of duty crime, Tang dynasty had not only emphasized strict punishmentof corrupted officials, but also stressed the prevention of duty crime. On one hand, rigorouslegal system that had been put in place served as a deterrent for officials; on the other hand,official selecting, assessing, supervising as well as educating had prevented them fromdoing so. The achievements made in preventing officials from corruption or crimecommitment in Tang had stabilized the royal ruling and promoted social development,making Tang dynasty run ahead of the rest of the world or even many following dynastiesin many fields. Some of them are still of practical guidance up till now.This paper, through researching into the Tang prevention of duty crime, tries to sortout the experience that can be drawn to prevent duty crime in modern society.The paper isdivided into four parts.Part one prevents an overview of the legislation against duty crime in Tang dynasty.First of all, the concept of duty crime is defined in order to examine the duty crime in Tangfrom modern perspectives. Secondly, the evolution of pre-Tang legislation against dutycrime is combed so as to discuss the historical origins of Tang legislation against duty crime. Lastly, Tang legislation against duty crime will be discussed as a key point.Part two introduces the prevention of duty crime in Tang dynasty.As the main body ofthis paper, this part will focus on the elaborations of the prevention system of duty crime inTang dynasty, which include four aspects, namely official selection mechanism, officialperformance system, supervisory system and education of officials.Part three assesses the prevention system of duty crime in Tang dynasty. From threeangles, this part will sum up and analyze the characteristics of the system, discuss itsdefects and limitations, and probe into its historical role during that time.Part four expounds on the reference value of Tang prevention of duty crime to modernsociety. Through discussions of institutional building, enhancing supervision,anti-corruption education of civil servants, cadre management and staffing, etc., the paperproposes to draw on the successful experience of Tang prevention system of duty crimeand learn from the severe mistakes.
