Organs and units of labor dispatch employment as the civil service system reform of a derivative form of employment, the early in development to alleviate the government departments to supplement and improve the service management functions to a positive role for austerity, man. And with the increasing number of organ of the labor dispatch, a series of labor malpractice also gradually, especially the protection of labor rights and interests of the dispatched workers, has received extensive attention from all sectors of society.This paper takes the labor rights theory, through the social investigation method, H district labor departments and units in Shanghai city to send the status of labor rights protection of the employees, and to the social exchange theory, hierarchy of needs theory as the research foundation, in-depth analysis of the existing problems and causes of organs in H District of Shanghai city unit of labor dispatch employees labor rights safeguard aspect, thus put forward the corresponding countermeasures. The objective is to enable the organs and units of labor dispatch protection of labor rights and interests of employees caused concern at the same time, can help the organs and units of labor dispatch employees get rid of "the two class citizen" dilemma, which makes their legitimate rights and interests should be effectively guaranteed.This paper is divided into six chapters:The first chapter:the purpose and significance of the study as a starting point, the research value through the literature research at home and abroad this paper got, elaborates the core concept as well as the theoretical foundation, research methods and technical route determination.The second chapter:the background through the development from four aspects of social environment, employing units, labor dispatching units and workers to analyze labor H district administrative units in Shanghai City, the dispatched employment.The third chapter:the questionnaire statistical data as the basis, the questionnaire as the core, in-depth interview as a supplement, progressive survey Shanghai city H district departments and units of labor dispatch labor rights protection of employees in state.The fourth chapter:according to labor rights theory system, in order to discover problems, analyze problems, a detailed analysis of the H region of organs and units of labor dispatch in the protection of labor rights deficiencies and problems, and based on the social exchange theory and the hierarchy of needs theory as the guide, tries to analyze the deep reasons for these problems.The fifth chapter:according to the above analysis of the problem and reason analysis, from three aspects of the principles of feasibility, improvement suggestions, proposals, comprehensive discussion on Countermeasures to guarantee the rights and interests of the dispatched employees labor rights.The sixth chapter:the conclusion of the research of the paper is summarized, and described the prospect of the deficiencies of the thesis and the future.
