The Research On Diversified Supervision Of Charitable Foundation

The executive meetings of the State Council in October29,2014, the premier Li Keqiang proposed "To enhance the credibility of charitable organizations, the transparent pocket charity made everyone trust". This is the Party Central Committee and the State Council request to the charity foundations’ development again. The credibility of the enhancement is inseparable from the charity organization to ensure open and transparent, philanthropy become transparent pocket, need whole society diversified supervision. On the situation of the development of charity in China, the modern concept of charity foundations were set up late, the establishment of the special social background, the existence of government management offside, vacancy and dislocation, related laws and regulations is not perfect, the social external and internal supervision are weak, constitute the main causes of recent fund scandal prone. So, how to evaluate China’s charitable foundations’ diversified supervision, affects the construction of credibility of charity and the future direction of development directly.As the development of China charitable foundations started late, the background established special, the supervision mechanism of the fund will exist a series of problems. The legal system is not perfect, the social external supervision is weak and the organization of internal supervision have constitutes the main reasons in recent scandals. This paper analysis three lack angles of supervision. The first is the government supervision. The government plays a leading role in the foundation of regulation. As the laws and regulations in our country is not perfect, the governments don’t have strong enough support in supervision. Together with the dual management system, government departments play both organizer and supervisor roles in public foundations, which make the supervisory role more difficult. The second is the weakening of social supervision. At present, the media in our country doesn’t have enough power of supervise as the western, what is more difficult is individual citizens to supervise the foundations. The third is shortening of foundation self-discipline. As a voluntary organization, do not for profit purposes, and moral requirements become the highest standards. But the personal moral quality cannot become the standard for every member of all foundations. The foundations’ self-discipline in fact is an appeal of the internal supervisory system. Aiming at the lack of supervision exist in these three aspects, the article try to establish the regulation model of one body with two wings" which is designed to ensure the government’s main status in supervise, to improve the internal supervisory system, and to establish the independent third party organization gradually. By this model, it is make a multi-power control on foundations to offer a necessary protection in a health and rapid development.
