Research Of Protection Of Children’s Rights In China

Right is a kind of capacity which is born from the beginning. And we need to achieve the rights through those laws. As a part of the rights family, children’s rights need to be paid more attention to protect. Children are the future and hope. Thus, it will be significant measures for the protection of children’s rights and their healthy development that we try to ensure their rights and establish a protection system for the abused children.However, during our present law systems and theories, there are not so many research theories and perfect protection measures, especially in the legal relief. There are not appropriate laws to rescue the abused children and these exists law systems are far from operability. In a word, these protections cannot satisfy the need.Based on the background of the pass of declarations and conventions, the background from the foreign methods, the article attempt to sort out the children’s rights from four parts:Chapter one is introduction of concepts about children’s rights in detail. Firstly, we discuss the concept and range of children. Secondly, we do a research on the nature and contents of the protection system. Thirdly, we make sure that the two concepts are proper so that we can do the next analysis.Chapter two is introduction of foreign protection of children’s rights in detail. Firstly, we do a research about the measures on legal systems of children’s rights from American, Japan and some countries in the Europe. Secondly, we conclude the distinctive characteristics in those countries. Thirdly, we analyze the characteristics received from the foreign country protection of children’s rights.Chapter three is introduction of the questions and reasons of our protection of children’s rights. Firstly, we conclude the questions that exist in our country. Secondly, we analyze these reasons for the questions and find the flaws in the legal protection system in detail. Chapter four is introduction of the construction of protection of children’s rights. Firstly, we conclude the reason for the construction of protection of children’s rights. Secondly, the article takes different measures to construct the protection of the children’s rights based on the different reasons. And the article takes specific measures from civil law, criminal law and administrative law and so on.
