As a new economic growth point, e-commerce is becoming an important part ofeconomic activity, and brings our lives a comprehensive and profound change.E-commerce continues to create economic prosperity and social progress, ourtraditional legal and social orders are suffering huge impact and the challenges itbrings. In recent years, the news media frequently exposed a variety of e-commercedisputes, such disputes or civil disputes in essence, but if not adequately addressed,will further deepen the conflict between the parties, will not only affect the economicdevelopment of the Internet in China, and will lead to some social problems. How toproperly resolve disputes in large numbers of new e-commerce is a major issue thatwe must actively deal with. This article is in such a background of economic thinkingto generate e-commerce disputes.In the history of legal development, the right to relief and always constitute thesame dispute resolution process or activity, sharing the same set of mechanisms.E-commerce online dispute resolution mechanisms (ODR) is an important part ofe-commerce law, in line with the network of consumer disputes the dispute settlementmechanism of the requirements is an important barrier to the Internet era of consumerrights protection network. Therefore, this article is to study how to resolvee-commerce disputes point to explore issues related to online dispute resolutionmechanisms.The first part, through the analysis of e-commerce disputes some of the featuresof their own, the traditional interpretation of the dispute settlement mechanism of theimpact and challenges, specifically addressed the traditional system of negotiationand mediation, arbitration and litigation system in resolving the plight of e-commercedisputes, thus creating the need online dispute resolution mechanisms to adapt to thenetwork environment. The second part focuses on the type of online disputeresolution mechanisms and applies in our country, specifically including onlineconsultation, online mediation and online arbitration. And through the interpretation of each specific type of operation, so that people on online dispute resolution have aspecific intuitive understanding. The third part discusses the main issues ofe-commerce online dispute resolution mechanism in the presence of a specificapplication, indicating that online dispute settlement mechanism in China is still inthe exploratory stage, is not perfect in all aspects. The fourth part proposes to improveour online dispute resolution mechanisms some suggestions: First, to improve therelevant laws; the second is to regulate its operation rules and institutions; third is tobuild trust labeling system to ensure that the results of the online dispute resolutioncan be performed smoothly; Fourth is to improve public trust in Online DisputeSolution Mechanism...
