Justice, dating from the time of the ancient Greeks, is an important concept ofpolitical philosophy. It is still the central point that gets attention fully incontemporary philosophical and political studies.“Theory of justice” is written byRawls, a professor at Harvard University in1971. That arouses academic diversion ofmodern political philosophy springing up in the whole world. And it also arouses that“Theory of justice” is criticized from different academic views. These lead to newacademic view growing up. Now, almost all of philosophical and political literature isregarded as the responses to Rawls’ work. It tries to coordinate the relationshipbetween freedom and equality of justice theory. It enjoys great praise, meanwhile,suffering challenges from various aspects. The most important and representativeacademic views are Nozick’s liberal leftism and the “communitarians”. Nozick’sliberal leftism believes that Rawls gives up independence of liberty and restrictsfreedom through equality. However, the “communitarians” emphasizes equality andfriendly love between members of the community from another side and individualvalue produced by this. Sandel, a professor at Havard University Law School, is themost famous representative figure of communitarians. Sandel, being known as theleader of the socialist young turks, sharp criticized Rawls. He deconstructed thejustice theory of Rawls layer by layer. In the meantime, he gradually built his ownjustice theory framework. It can be called a political philosophy of feast being talkedabout since modern times that silence of political philosophy is brought into thepublic view by their rival theory and combative defense posture.Value regression and political equality is mainly from the Sandel and Rawls’justice theory system of moral theme, value orientation and the confrontation ofpolitical practice. Its core value proposition is the contrastive analysis that which isfirst for right and good. This further leads to the two different between the value andthe power of the theory of justice, contravallation of distributive justice andopposition of Procedural Republic and political institution of republicanism. And it concludes both theory substance and their difference that Rawls’ politics of rights andinterests underlines equal rights in intuitive sense and Sandel’s public interest politicspraises highly the value of equality on constructive reflection. Finally, this paperanalyses both justice theory from the perspective of Marxist historical dimension andexplains the confrontational claims on gain and loss of critical force in the justice ofMarxism. And it finally is concluded that both the justice theory become a theoreticaldream and practice of utopia, if they ignore the economic basis and decisive factor inhistory. It is really achievable only based on the historical materialism of Marxismjustice.
