Study On The Legal Issues Of Urban Traffic Congestion Control

With the continuous improvement of the rapid development of urban construction and the people’s living standards, people’s desire of fast travelling even more intense, but increasingly congested roads and deteriorating environment has indicated that the plight of urban traffic is currently enjoying, this dilemma is not only restrict the sustainable development of the city, but also greatly reduces the happiness of the people living in the cities. Therefore, to controlling the traffic congestion, improving the quality and efficiency of travelling has become a priority pressing problems for the governments. So that the institutionalization and legalization measures to control the traffic congestion is the fundamental way to protect citizens’ rights and improve the efficiency of the urban traffic.This paper analyzes the problems of the traffic congestion, combing the main problems which exists in the traffic laws and systems, under the guide of the public governance theory, the externality theory, the urban transport sustainable development theory, put forward suggestions on the problems of the system, such as the management of city traffic congestion as an important content, making traffic laws and regulations, improve the coordination mechanism of city planning and traffic planning implementation of traffic demand management, the development of public transportation system, the development of intelligent transportation system, bus specification etc..In addition, this paper puts forward the legislative suggestions of congestion pricing, for traffic congestion charge on the subject, object, the collection area, time, charging standards and charging technology, the use of the congestion charge, congestion charge made analysis of the monitoring and tracking, etc. Also this paper provides further vehicle restriction, limit line, improves the parking-related legal system, improves the traffic participant legal liability system, and so on. In order to be able to offer the advices with reference value for our management of urban traffic congestion.
