The Research On The Legal System Of City Traffic Congestion Charges In China

With the economic and social development of our country and the accelerating process of urbanization,the motorization of Chinese cities has entered a period of rapid development.Traffic congestion has become more and more serious.Traffic congestion charging system has increasingly attracted the attention of the society and academia.Based on the concept of administrative fees,administrative taxes,and market prices,this article analyzes the equivalent compensation and treating benefits of the theoretical differences,and the conditionality of administrative fees reform in practice.As traffic congestion charging is based on the principle of fair burden on road resources,it reflects variability and benefit specificity.Therefore,the administrative charging attribute of traffic congestion charges is a policy option that meets the characteristics of traffic congestion charges.At the same time,by comparing and analyzing the background,implementation process,specific measures,and implementation effects of traffic congestion charging cases in typical cities at home and abroad,experience and enlightenment are provided for the preconditions,system design,and supporting measures for implementing traffic congestion charging in China.Afterwards,this paper focuses on the practical exploration of urban traffic congestion charging in China.Traffic congestion charging has its own realistic background and policy soil in China,which is consistent with the concept of urban development in China and has the support of mature technology.At the same time,traffic congestion charges will not only help offset the shortcomings,deficiencies,and gaps in the current blockage measures,but also facilitate cooperation with other measures to form a joint force and jointly handle traffic congestion.The system construction of urban traffic congestion charging in China is a systematic system,which is guided by the principles of legality and proportionality,including legislative guarantees,organizational operations,institutional arrangements and supporting measures.
