Detaining education system which produced in the1980s, was a special productof the particular historical period, it has played an active role in fighting againstprostitution operations. According to statistics, more than200detaining educationfacility has been building, number of detaining educator reaches40,000. However,as the introduction of Law of National legislative, Law of Punishment for PublicSecurity, Law of Compulsory administrative and so on, some people deem thatdetaining education system conflicts with laws, so they began to doubt therationality and legitimacy of detaining education system, even individual scholarsbelieve that it was the "draconian" which deprived of human rights and should beabolished. Review the history of legal system of our country, a number of laws andregulations always push some sensitive events, or to produce or perish. Case ofSunZhigang made "detention and repatriation system” abolished, Case of Tanghui’spetition boosts the demise of labor education system, recently actor HuangHaiboinvolved in prostitution triggered a new discussion of detaining education system.As a legal worker, nowadays I also had a keen interest in this issue, and thenconduct in-depth research. Recently, I had read a lot of comments and articles aboutthe detaining education system should be abolished which seems reasonable.However, with the deepening of learning, my point about detaining educationsystem had changed from “should be abolished” to “exist and improved”. Thesedays, I conducted in-depth research and extensive visits, compared detainingeducation system from both practical and theoretical level. Combined legal andrelevant laws and regulations of the legal basis for detaining education system, andthen discussed the function and value of detaining education system, reflectedexisting problems and deficiencies. Finally, according the current situation ofprostitution, this paper elaborated how to reform and improve detaining educationsystem in detail. I always felt that everything has necessity of its existence, weshould treat "abolish" more cautious than "build". In another word, it is better to “improve” than “"abolish”, which can make it reasonably and efficiently.
