Enlightenment On EU Resource Efficiency Movement To China’s Circular Economy Legislation

Resource efficiency is a core part of the development of circular economy, which isalso an important means to break’s the tension of China’s current environmental situation.In the background of reserves diminishing， resource constraints increasinglystrengthening, strengthen our resource conservation’s legislation, and promote resourceconservation core technology is imminent. However, the current practice of China’sresource use and recycling of economic and legal system still has many problems, such asthe ill-defined between adjusting object of the laws and regulations, less technicalrequirements, public participation, such as the lack of substantive content. This paperattempts to analyze the EU on the basis of resource efficiency policies，since the resource-efficiency campaign launched in EU, provide legislative proposals for our country’sdevelopment of resource efficiency in“Twelfh five-year development plan”, and explainthe use of specific measures in five areas: law, awareness of resource efficiency,management system, technical progress and public participation.The main contents of this paper is divided into four chapters:The first chapter discussed the legislation of circular economy before and after EUlaunching the resource-efficient campaign. The second chapter sorted the legal system ofChina’s circular economy, and redefine the “circular economy” concept. The third chapterin the basis on reality, from the view of resource efficiency movement, analysedproblems fathered of institutional missing and legal factors. The fourth chapter aimed toput forward suggestions for the theory and practice of China’s circular economy legislation,to revise and improve the “Circular Economy Promotion Law” as the core, tofoster awareness of resource efficiency, improve resource productivity, improveresource-efficiency management system, accelerate the pace of core resource efficiencyscientific research and technology, and promote public participation in the developmentof resource-efficiency use to institutional development. Finally concluded, summed upour country’s resources efficiency promoting, which is not only simple expansion of thelaw, but also deal with the existing legal resources for effective integration, resourcesefficiency and comprehensive utilization of unity to this “circular economy promotionlaw”, reduce the overlap of object between laws, adjust the logic clear, pay attention tothe game between resource efficiency and economic development, as well as empiricalanalysis and integrated use on specific systems of resource efficiency.
