A Research On The Mass Incidents Cause By Land Acquisition In Jiuquan

Since the conducting policy of the reform and opening-up, China has made tremendous achievements and drew the focus of the world. Meanwhile, with the rapid development of urbanization and economic development, various contradictions and conflicts occur frequently. Especially in the process of social change and benefit structure adjustment, incidents caused by land acquisition and demolition is one of the most intense conflicts for that it can easily lead to criminal, security question, group petition cases which is the key and difficult point of social management, standing in the way of building a harmonious society.A large-scale group event alarming the country occurred caused by land acquisition in Longnan City, Gansu province on November11,2008, finally, it evolved into a malignant cases impacting the municipal government. A survey for Chinese farmers’land rights situation published in the "Rule of Law Blue Book:China Law Development Report No.9(2011)" released in2011show that farmers’petition, disputes and even the mass incidents in rural areas are all concerned with land issues. The "Social Blue Book" published by Chinese Academy of Social Sciences in2013indicates that mass incidents annually caused by land acquisition accounted for about50%among as many as tens of thousands of mass incidents triggered by various social contradictions. It is a basic, holistic and strategic issue in the process of building a harmony community on how to correctly find the law of conflicts and disputes under the new situation, and how to explore the means and mechanisms to resolve these conflicts, thus enhance scientific and effective conflicts settlement; How to control the contradictions at the grassroots level, and how to resolve in the bud ensuring sustained social stability.On the basic studying, analyzing and observing the latest theory, such as harmonious society, letter petition system, administrative proceeding, by means of normative research and empirical analysis, taking the theoretical system of socialism with Chinese characteristics, the basic theory of administrative law and administrative procedure law, the theory of social conflicts as the evidence, in the background of’legal state, legal government and legal social construction’, in the target of building a legal modal reference for solving the land problems effectively, from the perspective of the mass incidents caused by land acquisition in Jiuquan, taking the current condition of land acquisition as the starting point of research, the content of the paper is filled.
