Legal Issues On Implementation Of The Agricultural Industry Planning

With the implementation of the household contract responsibility system, farmer s’enthusiasm for production got higher and higher, and the agricultural industry obtai ned a rapid development as well. However, the agricultural industry was caught in a b ottleneck as a market economy has been gradually established in recent years, and far mers’decentralized management mode also made their voice of increasing production become powerless. Faced with such a difficult task of increasing farmers’income and agricultural efficiency, the central and local governments positively changed their min d in the way of agricultural industry development, put the agricultural industry planni ng into practice and change the traditional agricultural industry mode to achieve the g oal of a optimal allocation of resources and farmers high yield. Nevertheless, the new agricultural industry planning turned out fail to achieve the desired purpose and it exp osed a lot of problems at the same time. Therefore, the study of the implementation of agricultural industry planning has a really realistic significance.The first part of this paper describes the concept and connotation of agricultural i ndustry planning in theory, and introduces its evolution as well as the status quo since the foundation of China. The second part summarizes several common problems in th e process of implementing the agricultural industry planning that exist in China, based on which implementation materials, such as the imperfection of legal system to prote ct the implementation of agricultural industry planning, the faultiness of its decision-making mechanism, the defective of law enforcement system, the errors of governme nts in implementing the planning, the imperfection of judicial relief system and so on. The third part relatively learns some legal experience in the implementation of agricul tural industry planning from the European, Japan, South Korea and India. The last par t puts forward some legislative proposals of perfecting the implementation of agricult ural industry planning in our country on the all above basis, aiming at the problems m entioned in the second part. As for legislation, the legal attribute of the implement of a gricultural industry planning should be clearly defined. Besides, the legal system of th e implementation,the decision-making mechanism, the enforcement mechanisms, the supervision mechanism and the safeguard mechanisms of the agricultural industry pla nning should also be improved. As for execution, the implementation mechanism of pi arming should be perfected, the role of collective economic organization like governm ent, the village committee, the collective economic organization should also be played to the full extent, and farmers’rights in economic development should be guaranteed absolutely to eventually promote the effective implementation of the agricultural indu stry planning.
