The Study Of The Treatment Of Juvenile Cybercrime

In twenty-first Century, the human society has entered the Internet era, in thisinformation society, the network provides a fast and efficient learning, working and livingpattern to the public. But with the network bringing us all kinds of the convenience, it alsoopens the dark side as "Pandora’s Box", cybercrime has also emerged at the same time. And itis worth mentioning that, teenagers are affected by the negative factors of network isparticularly obvious, the growing adolescent cyber crime has become a difficult socialproblem. From the perspective of developing future talents as well as the construction of lawsociety, it is indeed necessary to study the issue in depth to prevent and control adolescentcybercrime effectively, thereby creating a green network environment, promoting harmoniousdevelopment of society.This thesis is divided into four parts.The first part is an overview of adolescent cybercrime. This part firstly clears thedefinition of cybercrime; then it discusses the concept of adolescent cybercrime on that basis;lastly, it summarizes the current situation of adolescent cybercrime.The second part, the analysis of causes of adolescent cybercrime: this part respectivelyanalyzes the causes of adolescent cybercrime from two aspects of internal and external factor.Internal factors explore its causes from the adolescents’ two levels of own physiologicalcharacteristics and psychological characteristics; the external factors are from three aspectsrespectively of the economic, cultural and moral to make an in-depth analysis. Authorbelieves that the economic power brought by the "low-cost, high-yield" of cybercrime, amisleading that the "hacker culture" brings youth groups and inadequate network moralqualities, which are all the external factors causing adolescent cybercrime.The third part describes the status of governance of adolescent cybercrime. This partexpands from four aspects: First, it explores the loopholes in the current control measuresfrom the angle that the governance body‘s understanding differences on the adolescent’srelying on network; Second, it analyzes the status of governance from the perspective of theprevention capabilities for network security, pointing out that the lack of capability ofindependent innovation of computer technology, the poor network security management,security awareness of Internet users are the inadequate points; Third, it is analyzinggovernance obstacles from the perspective of Internet cafes; The fourth is to analyze relevant existing legislation on adolescent cybercrime governance and its defects.The fourth part is to put forward improvement suggestions on the adolescent cybercrimecontrol measures. The treatment of Juvenile cybercrime should be conducted from fouraspects including internet addiction prevention of adolescent, network security prevention,social governance and related legislation. In terms of internet addiction prevention ofadolescent, diverse interests and hobbies should be developed in adolescent and networkdependence reduced and we should build positive boot mechanism of network hobbies of theadolescent. In prevention for the network security, we must raise the network securitytechnology level, network management capabilities and improve network security awarenessof Internet users; In social management, we should strengthen the moral education of networkof young people to establish the "trinity" of education prevention system and strengthensupervision of Internet cafes to purify the network environment; As for the legislation, weshould legislate on adolescent cybercrime, modify and improve the criminal law provisionson the computer network crime.
