Research On Administrative Coordination Mechanism

Executive authorities enforcing the law and supervising social affairs should complywith the principle of legal priority,the principle of legal reservation and other basic principlesof administrative law.The law is always less than perfect;they areundistributed,abstract,indistinct, hysteresis.As the foundation and the guide of the lawenforcement,the Legislation existing defect and shortcomings,the effect of the lawenforcement is cut down,and the problem and difficulty emerges.In the practice of the lawenforcement, by organizing relevant departments together some local governments makethese problems due to the lack of legislation solved.This phenomenon is undoubtedly one ofthe signs of Executive authorities internal finding solutions to various problems caused bythe lack of legislation.This paper,based on the basic theory of administrative law and the newphenomenon and the new measure in the practice of the law enforcement,summarizes theconnotation of the administrative coordination, analyzes the reason for the emerge ofadministrative coordination,above all,provides targeted comments and suggestions.In this paper, in addition to the introduction and conclusion, there are four parts intotal.The first part raises questions according to a case. The lack of authorized legislation onfood safety, leaves food workshops unsupervised.By the way of Local governmentsorganizing relevant departments to coordinate,the problem above is solved.In the internal ofthe administrative systems, a kind of coordination mechanism is forming,which is closelyrelated to the deficiency of legislation and the pressure to fulfill administrative tasksefficiently during the transitional period. In reality we need to sum up the ptactice of theadministrative coordination and then establish and improve the administrative coordinationmechanism.The second part generalizes the connotation of the administrative coordination.Theadministrative coordination,is local governments’arrangement and deployment for thepurpose of insuring the successful implementation of laws and maintenance of theadministrative order in the administrative areas.The implementation of the administrativecoordination which is an administrative internal operation mechanism,is based on thecompetent authority of the executive and administrative leadership of localgovernments,relates to discretion of the relevant administrative departments. The third part analyzes the causes of the administrative coordination. The reasons whythe administrative coordination emerges during the law enforcement are as follow. First,because of the defect of legislation,the abstract,ambiguity,and diversity of the law,theexecutive authorities can not find instruction or guidance from time to time. Secondly,theadministration itself has the character of Positiveness and initiative，from this perspective，when facing with the problems and difficulties，the executive authorities will surely find theway.Finally,the advantages of the administrative coordination，provide guarantee for itsgrowing.The fourth part provides comments and suggestions for the important issues about theconstruction of administrative coordination mechanism. The local governments above thecounty level should preside the administrative coordination.The departments taking part inadministrative coordination include the local governments’affiliates and other administrativedepartment. The administrative coordination procedure start under both cases deciding by thehost itself and according to departments’application.The administrative coordination programshould set a certain time frame. The administrative coordination mainly solves unclearjurisdiction and law enforcement issue between different administrative departments. Theeffectiveness of the administrative coordination, depending on different participatingorganizations.The implementation of administrative coordination accompany with theexercise of administrative authority, so we make the administrative coordination regulated bylegal principles.
