Extra price in auto sales has become an unwritten rule in the market of China.This unreasonable phenomenon does harm to the contract interests of buyers, as wellas the legal rights of consumers. It has also disturbed the economic order of socialmarket and even reduced the interests of the state. It shall be under the legalregulation of contract law, consumer protection law, anti-unfair competition law,anti-monopoly law and other relative laws and regulations. There are a variety ofreasons to be account for this phenomenon and law is the edge tool to malfeasance, soa system of rules is needed here to establish a complete set of legal regulation.Besides the foreword and the conclusion, this paper is divided into the followingfour parts:The first part is phenomenon of extra price in auto sales. The author introducethe meaning of extra price and then list four kinds of main forms. The author alsoanalyze the market effects of this phenomenon.The second part is the theory analysis of the extra price. In this part, the authorreveal the irrational in extra price from the angle of jurisprudence, and then findingthe cause respectively from three aspects as producers, distributors and consumers.The author thinks we can adopt the order production mode, which is used in foreigncountries in order to eliminate the illegal phenomenon.The third part is the illegality of extra price in auto sales. The extra price isagainst with law. This part reveals the illegality mainly from the competition law,consumer protection law, price law, tax law and so on.The fourth part is consideration of enhanced law regulation. The principle ofgood faith due to play a part in the regulation. The competition law, consumer rights and interests protection law, price law, taxation laws, etc. can also take effect toperfect the relevant legal regulation.
