Analysis Of Duty Crime From A Criminal Psychological Perspective

Duty crime is a general social phenomenon，which is worldwidelyexisting to varying degrees. According to the economic structure, socialstructure and interest pattern in China and the deeply change in people’sideology, the social contradictions becomes more and more prominent.Moreover, the structure and mechanism are not perfect enough. All of thesecause the situation of duty crime quite unoptimistic.Anti-duty crime is an important task for all of the countries overthe world, and there had many research from different points of view. Sincethe founding of New China, the works on both preventing duty crime andenhancing theory have improved a lot. In respect of macro method, criminalact is a kind of social and legal phenomenon, while in micro methodindividual and psychological phenomenon. Therefore, basic on fullyunderstanding the definition, current situation and harmfulness of dutycrime, under the method and theory of criminal psychology, author analysesthe psychological cause and mechanism of duty criminal. The authorsincerely expected the results and the technique of the thesis couldpromote the duty crime research and the prevention work in practice ofour country. The thesis consists of three parts. The first part of this articlebegins with setting out different theory of concept of duty crime, andthen express author’s own opinion of duty crime. Thereafter, by analyzingthe current situation and harmfulness of duty crime, the author suggeststhe point of preventing it psychologically. Then, the author furtheranalyzes and illustrates the concept, types of criminal psychological ofthe duty crime to confirm the significance and necessarity of researchingon it. In the second part, author clarify the forming process andregularity of duty crime psychology and reveal the inner essence ofcausing the crime by three levels, which are the forming of personalitydefect, forming of criminal knowledge and forming of guilty mind. In thethird part of this article, author analyzes the transformation mechanismof the criminal psychology, research in the factors of positivetransformation mechanism and how to interfere these factors in order tohelp to control duty crime from the source.
