Research On The Diversified Treatment For Juvenile Crime

The research of the diversified approaches to the juvenile crime is existed through the increasing ratio of juvenile crime with the development of the society, the attention to juvenile’s growth and the education from the whole society. The modern criminal justice model symbolize by national prosecution and the modern penalty structure centered with a sentence of imprisonment is powerless to make up for the loss of the victim, restore social relations, human behavior transformation of the social effect, and also bring the problems of high cost, the transformation is not ideal and other issues. The paper starts from the basic theory of juvenile crime, and introduces several theories foundations of different judgments of juvenile and diversified approach. On this basis, by summing up the historical and theoretical basis for the development of diversified processing minor offenses, it reveals that the gap of diversified treatment of juvenile crime should be done and must be done. Combining with real analysis, the advantages and disadvantages of the approach to handle juvenile crime, this paper sums up the mode of different stages of litigation, superb legal and social solution of juvenile crimes.There are four parts in this paper. The first part introduces the basic problems of the diversified juvenile crime, including the different criteria to define juvenile crime, the characteristics and development trend of juvenile crime and related theory foundations. The second part describes the diversified juvenile treatment abroad, mainly about the U.S. model of juvenile courts and the Swedish welfare model. The third part introduces the current situation of diversified juvenile crime treatment at home, and makes an analysis combined with the results of field research from the pre-trial proceedings and trial, and then execution. The fourth part is the establishment of diversified juvenile treatment mode, mainly aims to improve domestic juvenile crime treatment mode for the lack of relevant theory and the current disadvantages.
