Study On The Improvement Measures For Civil Trial Management Of District Court In Dalian

Since2014, the Third Plenary Session of the18th Communist Party of Chinese made comprehensive arrangements for deepening the reform of judicial system. In the judicial system reform situation, trial management has also been given a new meaning. Diluting the administrative color, reverting the independence of the judiciary, is now the direction of the reform of judicial system. In such a historical background, the paper describes how trial management can play a more important role under the premise of judicial independence, what trial management would be like in all levels of courts, and how courts at the grassroots level in Dalian area could regulate its own trial management system during the implementation period of the judicial reform.The paper refers to research results of both domestic and abroad, under the current situation of court management at the basic level of Dalian City, through field research, summarizes the trial management work in recent years that the management right interfering with judicial right, and management entity overriding procedure excessively, as well as the judicial personnel has inadequate knowledge for the problem of trial management. And the reasons causing the problems are analyzed, in order to find out the breakthrough point to solve the problem. Put forward the theoretical basis of trial management, at the same time, by learning from foreign advanced experience of trial management, put forward suitable for civil trial management feasibility scheme of Dalian City Court, and put forward the improvement of feasible countermeasures according to the contents of the program, so as to further promote the trial management good operation, improving the quality of justice and judicial efficiency, to further promote the Dalian City People’s court trial right to run in a more fair way, further to provide theoretical support and technical support for the development and reform of grassroots courts in Dalian city. Improvement of trial management is the effective means to promote the judicial justice and efficient, we can continue to improve and perfect the trial management system, to make trial management play a greater role in the background of judicial reform.
