Research On Transplantation Of The People’s Republic Of China In The Former Soviet Union Legal System,1949-1957

Legal transplantation is a convenient way for the development of legal system, other countries or regions through transplantation success experience in legal system construction, the rapid development of the legal system of another country is of positive significance. Modern legal transplantation in our country’s history can be traced back to the late qing dynasty, from then on, the legal system construction of our country are learning to foreign countries, due to differences in cultural tradition and the situation varies from country to country, and the quality of people in the legal transplant is uneven also, causes our country the legal transplant is not plain sailing. The history of legal system of the Soviet union since the founding of the early transplantation is a more AD hoc transplant foreign legislation in our country, this article aims at the time of legal transplant historical figure, the cause of the legal system of the Soviet union, to transplant to comb, and analyze the migration process of gain and loss, analysis of transplanted the positive and negative significance of the Soviet union law, the reflection on the period of1957years what are legal construction falter implications. This paper is divided into four parts:the first part introduces the history of legal transplantation, and analyze the new China was founded in the early transplantation of legal system of the Soviet union; The second part of combing transplanted Soviet general situation of legal system; The third part to evaluate transplanted legal system of the Soviet union; Fourth part reflect on the period of legal transplantation, especially in the period of legal transplant’s influence on the development of legal system in our country after1957winding is analyzed.
