The Research And Study of Japanese Criminals’Community-based Treatment.Crime as a social phenomenon, it always walks with human society. Crime is the reason of criminal law and criminal law is the result of crime.Since1970s, countries around the world continue to innovate and reform the system of punishment, so under the such background community correction is the new way of punishment. The reason why community correction is widely acceptable is that as the development of social civilization, treating criminals in a non-violent way is an inevitable tendency.The community correction has achieved good effects in the punishment and remoulding of criminals, so that it widely used in jurisdictional practices and the mature development and utilization in Japan, as the typical representative of Civil Law system, which brings enlightenment to our country。 However, it is still having some problems and holes at the present stage. This thesis compares Japanese social treatment to European and American community correction so as to analyze the differences of systems, disadvantages or advantages and the development of tendency.This thesis discuss the criminals’community correction treatment encountering predicament in reality, considering the countermeasures and the way to perfect it. It hopes that through those reference, it can push forward our country’s community correction study. In detail, except the foreword and abstract, it divides into four parts.The first part is about Japanese community correction treatment system outline. This part briefly introduces such as the history of Japanese community correction treatment system, feature and the development tendency with the explanation of this thesis writhing background and Japanese community-based treatment system basic situations.The second part is the comparison of Japan to the representative European and American countries. This part first narrates the representative European and American countries’community-based treatment system and its features, which is the USA, UK, New Zealand and some other European and American countries’community concretion system with the analysis of main features. Later, this thesis compares Japan to the European and American countries’correction measures and mechanism.The third part is the advances and disadvantages Japanese criminals’ community-based treatment.In Japanese domestic, community-based treatment has its fixed method also own comparatively perfect legislation, implementing office and people, but we still can find some disadvantages and problems needed to solve by comparing with other countries. The forth part is Japaneses enlightenment to us from criminals’ community-based treatment. This part first points out our country’s community correction system existing problems, which is starting later, unfixed method and weak foundation, in accordance with Japanese criminals’ community-based treatment giving suggestions to our country, so as to scientifically solve problems in our country’s community correction system, better perfect community correction system.
