Research On The Right Of Information Security

After the world steps into the information society, problems about information security emerge in endlessly,which brings huge losses and bad influence to mankind. Lawyers have already discussed the issues of information. In terms of rights, information rights, right of personal information has been included in the research field. This intention is about information security rights which is putted forward from the angle of information security. As the name implies, information security rights is the guarantee of information security. The author believed that information security has independent value, security is a kind of instinct, the value of information security is irreplaceable for government, business, organization or individual. So a separate right of information security is put forward. Information security includes not only the contents of the information security but also the safety of information dissemination and communication, which is a dynamic process. Some scholars may ask if there are conflicts between the rights of information security and privacy. Since there is in-depth research of privacy, the right of information security is redundant or not. The author can say surely, the rights of information security and privacy here is different. Here the information is digital form. Privacy must become digital, text forms which can be transformed into information. Popular point said, the scope of privacy is greater than the scope of information security. However, the information in privacy is less than the information in information security, because privacy information is that who don’t want to be known by others, while the information in the information security refers to all information which can form objective data relating to the subject hold or application. The specific differences will be detailed in the below.This article is divided into five chapters. The first chapter includes introduction about summary and research on information security problem. The second chapter is about the basic theories of information security rights. Here the author will analysis legal status of the right of information security, and the necessity and feasibility of information security right to be putted forward. This chapter expounds the connotation of information security, and distinguishes between right of information security and the right of information, or the right of information security and the right of privacy. The third chapter analysis the extraterritorial experience at home and abroad on the protection of the right to information security, discusses the lack of legal protection and information security rights in China on the basis of the present situation in our country. The fourth chapter is about the thinking ofconsummating information security rights in our country. In this chapter the author will describe the basic law of information security and the relief way of information security rights. The fifth chapter is conclusion.
