Along with the development of China’s market economy as well as citizens’ gradual weakening consciousness on personal attachment to units, citizen interest is moving towards diversification. In the public management, there is a growing demand for the government’s administrative service by the public. Public participation in the area of administration is emerging gloriously, and the innovation of traditional the administrative law science is in urgent need. Under this background, this paper focuses on the status and function of public participation system in China, aiming to find out the problems in the implementation process. For instance, the effectiveness of public participation cannot be ensured. Finally, a series of corresponding measures are proposed.This paper can be divided into four parts. The first part introduces the concept of public participation system and its theoretical basis. The five types of public participation in current China are also involved, including the hearing, symposium, demonstration meeting, advisory committee, contact launched by citizens and so on. The second section is about the function of the system, which is discussed from three aspects, namely, civil rights, enhancement of the quality of administrative acts and achievement of the effectiveness of administrative acts. The ideal goals of the system in its establishment and implementation will be highlighted, based on which its effect of deviations in real practice is explored in the subsequent parts. In the third part, the status and problems of public participation are discussed. Specifically, public participation doesn’t reach the ideal effect, and the function of the system is not fully exerted. As a result, there appear two extreme cases in reality: the participation effect is too high or too low. This part attempts to investigate the reasons behind the phenomenon with purpose of providing foundation of the optimization of the system. The last part points out the direction and corresponding measures for the optimization of public participation system, aiming to help the system fulfill its proper functions.
